In the Indian legal system, the provision of 'anticipatory bail' (or pre-arrest bail) is a crucial safeguard for individuals who apprehend arrest on an accusation of having committed a non-bailable offense. Unlike regular bail, which is sought after arrest, anticipatory bail grants protection from arrest itself, allowing a person to approach a Sessions Court or High Court before an arrest is made.

This provision, enshrined in Section 438 of the Code of Criminal Procedure (CrPC), aims to protect individuals from false implication, malicious prosecution, or harassment. When granting anticipatory bail, courts consider several factors, including the nature and gravity of the accusation, the applicant's past record, the possibility of the applicant fleeing from justice, and whether the accusation has been made to injure or humiliate the applicant.

Securing anticipatory bail can prevent unnecessary detention and allow an individual to cooperate with the investigation without immediate loss of liberty. However, it's not an absolute right and requires strong legal arguments and evidence to convince the court. It's a powerful legal tool that underscores the principle of 'innocent until proven guilty.'
